Hoot O'Clock Terms of Use
Last updated: 20 October 2026
These terms set out the rules for using the Hoot O'Clock app, which helps children aged 5–8 learn to tell time on an analog clock. By using the app you accept these terms. If you do not agree with them, do not use the app.
1. Provider
Trixsoft Kamil Nędzaul. Augustyna Szamarzewskiego 21 lok. 2, 60-514 Poznań, Poland
Tax ID (NIP): 6282218350, REGON: 383379280
Email: [email protected]
2. Children and parents
The app is made for children, but the parent or legal guardian is the party to these terms. The parent decides whether the child uses the app, accepts these terms and is responsible for any purchases.
Creating an account, settings, the progress report and purchases are only available in the parent zone, which is protected by a parental gate. A child does not need to provide any personal data to learn with the app.
3. Account
After "Continue as guest" the app creates an anonymous guest account. In the parent zone, a parent can turn it into an account with an email address and password. The account is shared across Trixsoft apps.
Keep your password to yourself. A guest account cannot be recovered after the app is uninstalled or on another device, so if you buy the full version or a subscription, we recommend creating an account with an email address.
4. Free and paid features
The app is free to download. Free play with the clock is always free. Some levels and features (for example all levels, "Practise mistakes" and the progress report) are only available in the paid version. The app shows which features are paid before you buy.
You can unlock the paid version in two ways:
- One-time purchase — a single payment that unlocks the paid version for as long as the app is available, with no renewals.
- Subscription — access to the paid version for a set period (for example a month or a year) that renews automatically.
The price, the subscription period and the details of any free trial are shown in the app before you confirm the purchase. Prices include taxes required in your country.
5. Payments and subscriptions
- Purchases are made through the App Store (Apple) or Google Play (Google). The payment is charged to your Apple ID or Google account when you confirm the purchase. We do not receive your card details.
- A subscription renews automatically for the same period and at the current price, unless you turn off auto-renewal at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the end of the current period.
- You can manage or cancel a subscription in your store account settings: on iPhone in Settings → [your name] → Subscriptions, on Android in Google Play → Payments & subscriptions → Subscriptions. After cancelling, you keep access until the end of the paid period.
- If a free trial is offered, any unused part of it ends when you buy a subscription.
- Uninstalling the app or deleting your account does not cancel a subscription. Cancel it in your store account settings.
6. Restoring purchases
Purchases are linked to your store account and to your Hoot O'Clock account. On a new device or after reinstalling the app, sign in to the same account in the parent zone and tap Restore purchases.
7. Refunds and right of withdrawal
Purchases are sold through the App Store or Google Play, so refunds are handled by the store under its own rules. You can request a refund from Apple at reportaproblem.apple.com and from Google in Google Play (Order history).
The paid version is digital content delivered immediately. When you buy it, you agree to immediate delivery, and once it is delivered you lose the 14-day right of withdrawal provided for consumers in the European Union. This does not limit your rights in case of defects (section 8).
8. Complaints
If the app or the paid version does not work as it should, email [email protected]. Describe the problem and include the device model, the system version and the app version. We will respond to your complaint within 14 days. Your statutory rights as a consumer, including your rights if digital content does not conform to the contract, are not affected.
9. Licence and rules of use
We grant you a non-exclusive, non-transferable licence to use the app for personal, non-commercial purposes. The app, its graphics, sounds and code are protected by copyright. Do not copy, modify, distribute or decompile the app, except where the law allows it, and do not use it in a way that interferes with its operation or harms other users.
10. Availability and liability
We work to keep the app running smoothly, but we cannot guarantee it will always be available and error-free, for example during maintenance or a network outage. Learning works offline, while some features (account, copying results) need internet access.
We may develop the app and change its features. We will not take away paid features you have already bought, unless the law or the store requires it. If we ever have to withdraw the app, we will let you know in advance.
We are liable under applicable law. Nothing in these terms excludes or limits liability that cannot be excluded or limited under the law, in particular towards consumers.
11. Ending use
You can stop using the app at any time and delete your account: delete your Hoot O'Clock account. We may block an account that is used in serious breach of these terms, after first contacting you if that is possible.
12. App Store
If you downloaded the app from the App Store, Apple's Licensed Application End User License Agreement also applies. These terms are an agreement between you and Trixsoft Kamil Nędza, not Apple. Apple is not responsible for the app, its content, support or claims related to it.
13. Privacy
How we process data is described in the Hoot O'Clock Privacy Policy.
14. Changes and governing law
We may change these terms, for example when we add new features or the law changes. We will announce material changes on this page and in the app before they take effect. Changes do not affect purchases already made.
These terms are governed by Polish law. If you are a consumer, you keep the protection given to you by the mandatory laws of the country where you live. Disputes may be resolved by the competent court or, if you choose, out of court, for example through consumer ombudsmen or the Trade Inspection.
